• Introduction

SPSPI Smart Pay Services Payment (CYPRUS) LTD is a Payment Institution licensed by the Central Bank of Cyprus (PSD2 License), with company registration number HE 164189. 

  • Money remittance

Money transfers worldwide could normally take from 5 minutes up to seventy-two (72) working hours (excluding weekends and holidays and limited to the hours of operation of the receiving partner). Money transfers will normally be paid out in cash or bank deposit, in the currency available and agreed at the point of sale.

Sending transfer:

You must provide us with information which clearly identifies:

  • The recipient’s full name and contact number and/or
  • details of the recipient’s payment account (if they have one); and/or
  • any other relevant information required to proceed with the money transfer.

Receiving transfer:

You must provide us with the following information:

  • The recipient’s full name
  • the recipient valid photo ID
  • any other relevant information required to proceed with the money transfer.

The transaction should be received by the beneficiary in 30 days. Transactions that have not been collected after 30 days will be automatically canceled and refunded to the sender.

The customers must always provide the relevant documentation that SmartPay may request as it may be required to comply with local and foreign laws on money remittance transactions.

SmartPay collects the necessary information to process your transaction; the use of your personal information is regulated by the Central Bank of Cyprus (PSD2 License), with company registration number HE 164189. Your personal information will only be shared with our business partners to execute payment of your transactions, it is not shared with any other third parties or used for any incompatible purpose, except as required by law. The information is retained only for the time stipulated by regulatory authorities. If you wish to access to your information, or have any questions about our Privacy Policy, its implementation or the use of your information, please contact our Main Office; you understand and accept the use of your personal information. SmartPay is a registered Data Controller under the Data Protection Act, duly registered as such by the Information Commissioner’s Office.

  • Eligibility

To be eligible for our Services, you must be at least 18 years old. You further represent and warrant to us that if you are an individual and you are registered with us, that you are not acting on behalf of an undisclosed principal or a third party. SmartPay reserves the right to access various government and private databases to verify and validate the information you supply us.

SmartPay reserves the right to refuse to accept any new user or any transaction at its discretion. We do not keep payment information in our database.

  • Pricing

The prices for the Service consist of the Fees and Exchange rate (if applicable).

Our Fees vary from time to time, but changes in the Fees will not apply to any orders in respect for which we have already sent you the Confirmation.

Discounts on our Fees may be available through promotions that we or our partners may offer from time to time. Promotions are subject to terms and conditions and will be honoured in accordance with their published terms.

If you pay by bank card it will be charged as soon as we accept your request for the transfer.

SmartPay is not liable for any additional fees that the Banks or by card issuer (either on the sending or receiving side) may charge.

When you pay by bank card and your order is refused by your Bank or by the card issuer, your bank account will not be debited. However, it is possible that your Bank or the card issuer might hold the amount you tried to send. If this happens you will need to contact your Bank or card issuer to resolve the issue.

SmartPay must receive cleared funds from you, prior to any payments being made for you and you understand that we do not offer any credit. Once your funds are received by SmartPay (and cleared) we endeavour to start processing your transfer request as soon as possible (please consider bank holidays, cut off times, local bank holidays).

In addition to the service fees applicable to the transaction, a currency exchange rate set by SmartPay or its representatives may be applied. You will be informed of the commission charges and exchange rate that may apply BEFORE the transaction is processed.

  • Cancellation & Refund Information

If you wish to cancel the transaction and request a refund, please contact us:

We will generally refund principal amount which you made to us before exercising your right of cancellation, but: we may not refund the commission as a reflection of the costs already incurred by us except when the cancellation is due to an error by SmartPay ;

  we will not refund you after the transaction was completed and/or paid out before we receive your notice of cancelation; SmartPay has a right to reject any transaction at its judgment.

SmartPay may refuse the payment order if we cannot match the client name and address as provided to SmartPay to your card details.

All refund requests must be accompanied by a copy of the original ID and transaction control number.

If you made a transaction through our branch, you must visit this branch where money sent from to request a cancellation and refund. Refunds can take up to 7 working days to be 

processed and this depends of partner confirmation of cancellation. We aim to process such request promptly but, in any case, within 30 days.

Any refunds will be credited back to the same payment method has been used to fund the transaction and in the same currency. All written refund requests will be subject to SmartPay review and discretion.

  • Compliance

SmartPay will not accept third party funds as stated by the Money Laundering Regulations 2017. Please ensure no third parties have access to your personal details as it is your responsibility that any passwords, pin numbers, security questions set out by SmartPay to protect you, are not used by third parties.

  • Complaints

At SmartPay, every customer is important.

In the unlikely event that you are dissatisfied with any of the services we perform in the first instance in accordance with our Complaint’s procedure.

  • Law and Jurisdictions

These Terms of Service and all matters arising from or connected with them are governed by English law. The courts of England have exclusive jurisdiction to settle any dispute arising from or connected with these Terms of Service. The laws of the country you are transferring money may be different from English law, including laws governing what can be legally offered, sold, exported, bought or imported. There may be additional legal requirements. You shall comply with all applicable domestic and international laws. There is no practical way for us to continually monitor the laws of every country, or each user transaction.

Any dispute or claim arising in connection with this Terms of service will be considered in relation to the English version only.

  • Intellectual property

All text, graphics, logos and images, as well as all other SmartPay copyrights, trademarks, service marks, products and service names are the exclusive property of SmartPay, and may not be used for any purpose without express written permission from SmartPay.
